If an exchange of money for the use of the image and you have nothing, that is their friend and the owner of this picture, because obviously a copy. If there is an exchange of shares of money to say that the money, and if there is no threat to the small claims court. This problem does not occur to the definition of plagiarism, nor the provisions of copyright law and the painting never belonged, and plagiarism is to copy the written work of another person.

I assume you're American law. This is a subject of copyright. Copyright results almost automatically. You do not need to apply for registration of copyright for a copyright to a photo. Registration you will receive some nice benefits, but registration is required to exist for the copyright. Although there is a minimal degree of creativity in photography to a very simple standard (meet) is, is the property of the photo. The real question is, who the copyright.

Who has the photo on your commitment ceremony? Professional Photographers of the contract specifies, in general, that the copyright of their own. In this case, the copyright of the photographer and may even be a person who copied the image.

On the other hand, if you ask a friend to take pictures for you, you can include the copyright. In this case, you have the right to go to court, a person to prevent his photo copied.
